Lo scritto ripropone, con alcune modifiche e puntualizzazioni, il testo presentato per l’audizione sull’elezione diretta del Presidente del Consiglio dei Ministri tenuta il 6 agosto 2024 innanzi alla Commissione Affari Costituzionali della Camera dei Deputati. L’Autore, richiamando quanto rilevato dalla Commissione europea nella sua relazione sullo stato di diritto dedicato al nostro Paese, si sofferma, da un lato, sulle “preoccupazioni” in merito ai possibili effetti sull’ordinario sistema degli equilibri istituzionali, non garantendo la riforma proposta dal Governo la conservazione dei necessari checks-and-balances; dall’altro, solleva dei “dubbi” sul fatto che le modifiche proposte possano apportare maggiore stabilità, ovvero che siano in grado di conseguire il principale obiettivo dichiarato dell’intera riforma.

The paper proposes, with some amendments and clarifications, the text presented for the hearing on the direct election of the President of the Council of Ministers held on 6 August 2024 before the Constitutional Affairs Commission of the Chamber of Deputies. The Author, recalling what was found by the European Commission in its report on the rule of law dedicated to our country, dwells, on the one hand, on the “concerns” regarding the possible effects on the ordinary system of institutional balances, not guaranteeing the reform proposed by the Government the preservation of the necessary checks-and-balances; on the other hand, he raises “doubts” as to whether the proposed changes can bring greater stability, i.e. whether they are able to achieve the main declared objective of the entire reform.
