Lo scopo del presente contributo è quello di proporre una riflessione sul grado di integrazione della scienza nel formante legislativo all’interno dell’ordinamento italiano. A tal fine, premessa una breve ricostruzione della libertà della scienza nel tessuto costituzionale, vengono individuati tre diversi livelli di interazione e di complessità del rapporto tra legislatore e scienza. Alle considerazioni sulla scienza come oggetto della regolazione (leggi a contenuto scientifico e organizzazione dell’attività scientifica), verranno affiancate alcune riflessioni sulla scienza come strumento per la normazione e, infine, come soggetto che provvede ad autoregolarsi (research integrity). Queste diverse declinazioni del fattore scientifico nel tessuto costituzionale e nel formante legislativo vengono ricondotte ad unità attraverso il recupero della funzione sociale della scienza, recentemente posta in evidenza dalla pandemia.

The aim of this contribution is to discuss the degree of integration between science and legislation in the Italian legal system. To this end, after a brief presentation of the concept of the freedom of science in the constitutional context, the essay highlights three different levels of interaction and complexity of the relationship between legislator and science are identified. The first one considers science as an object of regulation (laws with scientific content and organization of scientific activity); secondly, science could be seen as a tool for legislation and, finally, as a subject that finds its rules for self-regulation (research integrity). These different declinations of the scientific factor in both the Constitution and the legislation are brought to unity through the recall of the social function of science, that has recently been highlighted by the pandemic.
