La ripresa del dibattito sull’opinione dissenziente è stata favorita dall’atteggiamento di apertura che caratterizza oggi la Corte costituzionale italiana. È preferibile utilizzare una prospettiva prevalentemente oggettiva per valutare l’impatto dell’opinione dissenziente nella giustizia costituzionale italiana. Occorre tener conto delle conseguenze che si produrrebbero non tanto sullo status del giudice costituzionale quanto sulle funzioni esercitate dalla Corte costituzionale. Nel contesto attuale la Corte costituzionale potrebbe decidere direttamente l’introduzione dell’opinione dissenziente modificando le norme integrative o utilizzando la prassi giurisprudenziale. Ma è proprio questo atteggiamento della Corte italiana, aperto e incisivo a livello giurisprudenziale, a far dubitare dell’opportunità di inserire nel processo costituzionale l’istituto dell’opinione dissenziente. L’introduzione dell’opinione dissenziente comporterebbe un ulteriore sbilanciamento verso l’ambito politico che oggi è meglio evitare.

The resumption of the debate on the dissenting opinion has been encouraged by an attitude of openness that nowadays characterizes the Italian Constitutional Court. It would be better to consider a mainly objective perspective to value the impact of the dissenting opinion on Italian Constitutional Justice. Account must be taken on the consequences that would occur not on the status of constitutional judge but on the functions of the Constitutional Court. In the current context the Constitutional Court could directly decide the introduction of the dissenting opinion amending the Supplementary Rules or applying the jurisprudential practice. However, this open and incisive attitude of the Constitutional Court raises doubts about the opportunity of introducing the dissenting opinion in the constitutional process. The introduction of the dissenting opinion would involve a further unbalance towards the political sphere that it is better to avoid these days.
