Con la globalizzazione, i poteri che contano si sono trasferiti fuori dei confini degli Stati nazionali e stanno recando aggressioni crescenti al futuro dell’umanità: il riscaldamento climatico, le guerre, la minaccia nucleare, la crescita delle disuguaglianze e delle violazioni dei diritti umani. Il costituzionalismo, quale sistema di limiti e vincoli ai poteri, può sopravvivere solo se si espande, come costituzionalismo globale, al livello di tali poteri selvaggi. Ribaltando l’idea schmittiana di un nesso tra Costituzione e Stato, il testo sostiene che tale espansione equivarrebbe all’attuazione del carattere universale dei diritti umani e del principio di uguaglianza che formano la sostanza del costituzionalismo odierno, oltre che la sola risposta realistica e razionale a un futuro di catastrofi.

Globalization has displaced the powers outside the borders of nation-states. Powers that move growing assaults on the future of humanity: global warming, wars, the nuclear threat, the growth of inequality and human rights violations. Constitutionalism, as a system of limits and constraints on powers, can only survive if it expands, as a global constitutionalism, to the level of such savage powers. Reversing Carl Schmitt’s idea of a nexus between the Constitution and the state, the text argues that such expansion would amount to the implementation of the universal character of human rights and the principle of equality. These form the substance of today’s constitutionalism, as well as the only realistic and rational response to a future of catastrophes.
