Il dibattito pubblico intorno alle misure adottate per far fronte alla crisi sanitaria e socio-economica si sta svolgendo come se avessimo dimenticato che il primo dovere di un dominio politico è la sua autoconservazione: il grado di fiducia dei consociati nei confronti del sistema politico complessivo non è mai stato così basso e gli argomenti con cui la discussione intorno ai suoi comandi è presentata vengono per lo più ricondotti a un costituzionalismo sempre più ingombrante che ha ormai perduto la consapevolezza del pericolo delle tendenze autodistruttive del sistema stesso. Di qui la questione provocatoria: il costituzionalismo è vittima o carnefice di queste tendenze autodistruttive?

The public debate around the measures adopted to cope with the health and socio-economic crisis is unfolding as if we had forgotten that the first duty of a political domain is its self-preservation: the degree of trust of associates in the overall political system has never been so low and the arguments with which the discussion about its commands is presented are mostly traced back to an increasingly cumbersome constitutionalism that has now lost awareness of the danger of the self-destructive tendencies of the system itself. Hence the provocative question: is constitutionalism the victim or the perpetrator of these self-destructive tendencies?
